Terms and conditions

Reuses the current published terms wording. Layout only — no change to legal meaning.

If you have any questions, email us at [email protected] .

These Terms & Conditions (“Terms”) apply to your access to and use of the Digicue Scan website (“Website”) and any products or services purchased through it. By using this Website or placing an order, you agree to these Terms.

About Digicue Scan

Digicue Scan is operated by Digicue (“we”, “us”, “our”). We sell products online via this Website.

Our products are Australian made and designed and produced in small batches to maintain quality and help minimise errors. Because products are made in batches, there may be minor variations between runs (including finish, colour tone, packaging, or small design refinements). These do not affect your rights under Australian Consumer Law.

Eligibility and acceptable use

You must be at least 18 years old (or have permission from a parent/guardian) to place an order.

You agree not to use the Website for unlawful purposes, attempt to access restricted areas of the Website or interfere with security, introduce viruses or malicious code, or misuse the Website in a way that impacts other users.

Product information and availability

We aim to keep all product descriptions, images, pricing, and availability accurate and up to date. However, product images are for illustrative purposes and may vary slightly from the delivered product, availability may change without notice, and we may correct errors (including pricing or description errors) at any time.

If we discover an error that affects your order, we will contact you and provide options (such as proceeding with the corrected details or cancelling the order).

Orders and acceptance

When you place an order, you are making an offer to purchase products under these Terms.

An order is only confirmed once payment has been successfully processed and we accept the order (usually by sending an order confirmation email).

We may cancel or refuse any order where permitted by law, including where payment cannot be verified, there is a pricing or stock error, we suspect fraudulent activity, or delivery is not possible to the address provided.

If we cancel an order after payment is taken, we will refund you in full.

Pricing and payment

All prices are displayed in AUD unless stated otherwise.

We accept payment methods shown at checkout. Payments may be processed by third-party payment providers. By purchasing, you agree to comply with the terms of those providers.

You agree to provide accurate billing, contact, and delivery details. Additional verification may be required for some transactions.

Shipping and delivery

We ship to the locations listed at checkout.

Dispatch and delivery timeframes shown are estimates only and may vary due to factors outside our control.

You are responsible for ensuring your delivery address is correct. If a parcel is returned due to an incorrect address, you may be responsible for additional shipping charges to re-send it.

Risk in the goods passes to you once delivered to the nominated address (or once collected, if collection is offered).

If your parcel is delayed, missing, or marked as delivered but cannot be located, contact us promptly so we can assist with the carrier investigation.

Returns and refunds (30-day return policy)

We offer a 30-day return policy from the date you receive your order, in addition to your rights under Australian Consumer Law.

Change-of-mind returns: You may request a return within 30 days if you change your mind, provided the item is unused, in original packaging, in resalable condition, and you provide proof of purchase.

Change-of-mind return costs: Return postage is your responsibility (unless required by law). Original shipping costs are not refundable (unless required by law).

Faulty, damaged, or incorrect items: If your item is faulty, damaged in transit, or not what you ordered, you may be entitled to a repair, replacement, or refund under Australian Consumer Law. Contact us as soon as possible with your order number, a description of the issue, and photos where relevant. Where the issue is confirmed, we will cover reasonable return postage and organise the best resolution.

Items that may not be eligible for return (to the extent permitted by law): Items that have been used, altered, or damaged after delivery, items returned without original packaging where this prevents resale, items showing signs of misuse or abnormal wear, and clearance items marked as final sale at checkout. This does not affect your rights under Australian Consumer Law.

How to lodge a return: Email [email protected] with your order number and reason for return. We will provide return instructions.

Warranties and Australian Consumer Law

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

Nothing in these Terms excludes, restricts, or modifies your rights under Australian Consumer Law.

Where permitted by law, our liability for any claim relating to a product or service is limited (at our option) to replacement of the product, repair of the product, refund of the purchase price, or re-supply of the service (if applicable).

Use of QR/NFC products and third-party platforms

Some Digicue Scan products may use QR codes and/or NFC technology and may link to third-party platforms (for example, Google, Facebook, Yelp, TripAdvisor or other review and social platforms).

You acknowledge that third-party platforms have their own rules, policies, and availability, we do not control third-party platform changes, outages, moderation, or account decisions, and performance may vary depending on device settings, operating systems, connectivity, and platform updates.

Intellectual property

All content on this Website (including text, product names, logos, graphics, images, and layout) is owned by or licensed to Digicue and is protected by intellectual property laws.

You must not copy, reproduce, distribute, or exploit any part of the Website without our written consent.

Website availability and security

We aim to keep the Website available and functioning smoothly, however we do not guarantee uninterrupted access. We may change, suspend, or withdraw the Website (or any part of it) at any time.

You are responsible for securing your device and login details (if applicable).

Privacy

Your use of the Website is also subject to our Privacy Policy. We handle personal information in line with applicable Australian privacy laws.

Promotions and discounts

From time to time, we may offer discounts or promotions. These are subject to the conditions stated at the time of offer and may be changed or withdrawn at any time.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss (including loss of profit, revenue, or business opportunity), and we are not liable for delays or failures caused by events outside our reasonable control (including carrier delays, supplier delays, power outages, or third-party outages). This section does not limit your rights under Australian Consumer Law.

Changes to these Terms

We may update these Terms from time to time by publishing the updated version on the Website. Continued use of the Website means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Australia and the state or territory where Digicue primarily operates. You submit to the courts of that jurisdiction.
